These Terms of sale apply to every purchase of an eSIM data plan on vietsim.com. Please read them before you pay. When you tick the consent box before checkout, you accept the version of these Terms published on the day of your purchase.
1. Who sells the eSIM
VietSim is a brand of LuKas Holdings sp. z o.o., ul. Stefana Batorego 18/108, 02-591 Warsaw, Poland, entered in the Polish National Court Register (KRS) under number 0001233010, NIP 7011306806, REGON 54439709700000, EU VAT ID PL7011306806 (“VietSim”, “we”, “us”).

We sell prepaid eSIM profiles that connect to mobile networks in Vietnam. The networks are run by Vietnamese mobile carriers such as Viettel, VinaPhone and MobiFone, which are not parties to your purchase. We buy the eSIM profiles from an authorised distributor.
2. What you buy
- An eSIM is a digital SIM profile. You install it on a compatible phone by scanning a QR code or by entering an SM-DP+ address and an activation code.
- Each plan shows the network, the data allowance (per day, in total or unlimited), the validity in days, whether calls, SMS or a Vietnamese phone number are included, and the price.
- A daily allowance renews every day on the carrier’s schedule. Once an allowance is used up, the carrier may slow down or stop mobile data until it renews or the plan ends.
- Plans work in Vietnam only. They cannot be topped up or extended unless the plan says so.
- Each eSIM profile must be activated before a deadline set by the carrier. When we sell a profile, that deadline is at least 3 days away. If you are buying more than a week before your trip, write to us first and we will confirm the deadline for your plan.
3. Phone compatibility
Before you buy, check that your phone supports eSIM and is not locked to a carrier. The plan page explains how. If your phone turns out to be incompatible and you have not installed the eSIM, you can ask for a full refund under the Refund policy.
4. Ordering and payment
- Prices are shown in US dollars. The total you pay, including any tax that applies, is shown on the payment page before you confirm.
- Payments are processed by Stripe. We never receive or store your full card details.
- The contract is concluded when Stripe confirms your payment. If the payment fails or the payment page expires, no contract is concluded and you are not charged.
- One purchase is one eSIM.
- We may refuse or cancel an order before delivery if we suspect fraud or if the plan is no longer available. If you have already been charged, we refund the full amount.
5. Delivery
- The eSIM is delivered electronically on the order page that opens after payment, usually within a minute. The page shows the QR code, the SM-DP+ address and the activation code.
- Save the link to the order page and keep it private. Anyone with the QR code can install the eSIM, and a profile can usually be installed only once.
- If automatic delivery fails, we contact you by email. If we cannot deliver the eSIM within 2 business days of payment, we refund you in full.
6. Right of withdrawal
If you are a consumer in the European Union, you normally have 14 days to withdraw from an online purchase without giving a reason. For digital content and services that are supplied straight away, this right ends once delivery has begun with your express consent and your acknowledgement that you lose the right.
Before checkout you ask us to deliver the eSIM immediately and confirm that you lose the right of withdrawal once the QR code is shown. After the QR code has been displayed on your order page, you can no longer withdraw under this right. The Refund policy still applies and gives you a full refund as long as the eSIM has not been installed.
7. Refunds
Refunds are handled under our Refund policy. In short: a full refund while the eSIM has not been installed, and a full refund if an installed eSIM does not work in Vietnam and we cannot fix it.
8. Using the eSIM
- Use the eSIM lawfully and within the carrier’s fair use rules. Do not resell it or use it in SIM boxes, for bulk messaging or for automated traffic.
- Vietnamese law requires mobile subscriptions to be registered to an identified user. If the carrier or our distributor asks for identity details to keep the line active, the line may be suspended until you provide them.
- Coverage, speed and availability are provided by the carrier and vary with location, buildings, time of day and network load.
9. Liability
- We are responsible for delivering a working eSIM profile that matches the plan you bought.
- Beyond refunding the price under the Refund policy, we are not responsible for losses caused by network outages, gaps in coverage or carrier decisions outside our control, or by installing the eSIM on an incompatible or locked phone.
- Nothing in these Terms limits liability that cannot be limited by law, including liability for intent or gross negligence, or your statutory rights as a consumer, including your rights if the eSIM does not conform to the contract.
10. Complaints
Send complaints to [email protected] with the link to your order page, a description of the problem and, if possible, screenshots. We reply within 14 days.
If you are a consumer, you can also get free help from a consumer advice body in your country. In Poland, this is the municipal or district consumer ombudsman (rzecznik konsumentów). Information about out-of-court dispute resolution is published by the Polish Office of Competition and Consumer Protection at uokik.gov.pl.
11. Personal data
We process personal data as described in our Privacy policy.
12. Changes to these Terms
We may update these Terms, for example when the law or our plans change. Your purchase is governed by the version you accepted before checkout. Each version carries its date at the top of this page.
13. Governing law and courts
These Terms are governed by Polish law. If you are a consumer, this choice does not take away the protection of the mandatory rules of the country where you normally live, and you may bring a claim before the courts of that country.
14. Language
These Terms are published in English and Vietnamese. If the versions differ, the English version prevails, except where the law of your country lets you rely on the version in your language.
